1) In case that shipper declared the value of cargo on the Air Waybill and the valuation charge was paid ;The liability of Korean Air shall be limited to the actual damages to the cargo, but in no event it shall exceed the declared value of cargo as stated on the Air Waybill.2) In case that shipper did not declare value of cargo on Air Waybill and the valuation charge was not paid ;The liability of Korean Air shall be limited to the actual damages to the cargo, but in no event it shall exceed SDR 22 per kg of the damaged/missing cargo according to Montreal Convention.
SDR(Special Drawing Right) is a kind of international reserve currency created by IMF. It is considered as the third currency following after gold & the U.S. dollar. In general, the carrier is responsible for Master Air Waybill data input, and the forwarder at departure station is responsible for House Air Waybill data input.
If forwarders can not send House Air Waybill data directly, Korean Air can input it on behalf of forwarders, charging an extra fee.

Customs office will impose penalty on data transmitter for irregularity of manifest data such as omission, inaccuracy, false report or import of embargo items.

The United Nations and governments around the world impose trade sanctions measures and strictly enforce Trade Sanctions Laws and Regulations against certain countries, entities, and individuals to achieve a variety of foreign policy and national security objectives. Especially, U.S. sanctions laws use the blocking of assets and trade restrictions to accomplish foreign policy and national security goals. C. How do U.S. Primary Sanctions and U.S. Secondary Sanctions differ? The “Primary Sanctions” imposed by the United States apply to persons and activities within U.S. jurisdiction, where the “Secondary Sanctions” target non-U.S. persons and companies that engage in certain targeted activity outside U.S. jurisdiction. “Secondary Sanctions” are called “Secondary Sanctions” because they do not involve direct enforcement action by the United States; rather, persons engaged in activities targeted by secondary sanctions laws might themselves be sanctioned by the United States. D. What happens if I(we) don’t comply with sanctions? Any person or company who violates Trade Sanctions Laws and Regulations can be imposed of substantial criminal, debarment or denial of export privileges and civil penalties including fines for both the individual involved in the violation. Also, the violation may result in imprisonment or a host of other ancillary penalties, even for unintentional violations. E. What shall an Agent do to comply with these Sanctions? For Agents who are engaged in air transport services for freight, it is important that all employees are informed and aware of applicable international trade sanctions of, but not limited to, United Nations, EU or United States, and comply with them. It is also extremely important for Agents to regularly and always be informed and updated of the most current Sanctions enforced, and check whether the shipper or consignee is one of the entities or persons targeted under the U.S. Primary Sanctions or Secondary Sanctions. These targeted entities or persons are called Specially Designated Nationals (hereinafter ‘SDN’) and are listed or updated frequently on The Office of Foreign Assets Control of the U.S. Department of the Treasury website.
